The domain name www.arghealthcare.in (hereinafter referred to as "Website") is registered in the name of Go Ads India Private Limited a company incorporated under the Companies Act, 1956 with its registered office at 2/SA/3, M.H.B, Basni,Jodhpur, Rajasthan 342005 (hereinafter referred to as “Arg HelthCare”).

Your use of the Website and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, You shall be contracting with Go Ads India Private Limited, these terms and conditions constitute Your binding obligations, with Arg HelthCare.

For the purpose of these Terms of Use, wherever the context so requires ‘You’ or “User” shall mean any natural or legal person who has agreed to become a member of the Website by providing Registration Data while registering on the Website as Registered User using the computer systems. Arg HelthCare allows User to surf the Website without registering; however for making purchases registration on the Website would be mandatory. The term “we”, “us”, “our” shall mean Arg HelthCare.

Membership Eligibility

Use of the Arg HelthCare Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Arg HelthCare Website. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the Arg HelthCare and shall not transact or use Arg HelthCare website. As a minor if you wish to use or transact on Arg HelthCare, such use or transaction may be made by your legal guardian or parents who have registered as users of the Arg HelthCare. Arg HelthCare reserves the right to terminate your membership and refuse to provide you with access to the Arg HelthCare if it is brought to Arg HelthCare’s notice or if it is discovered that you are under the age of 18 years.

Your Account and Registration Obligations

If You use the Website, You shall be responsible for maintaining the confidentiality of your User ID and Password and You shall be responsible for all activities that occur under your User ID and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website.

Charges

Membership on the Website is free. There is no charge or fee for browsing and buying products on the Website. However we reserve the right to charge fee and change its policies from time to time. In particular, we may at our sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event we reserve, without notice to You, the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the fee and related policies shall automatically become effective immediately once implemented on the Website. Unless otherwise stated, all fees shall be quoted in Indian Rupees.    • promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
   • infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];
   • promotes an illegal or unauthorized copy of another person's copyrighted work (see "Copyright complaint" below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
   • contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
   • provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
   • provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
   • contains video, photographs, or images of another person (with a minor or an adult).
   • tries to gain unauthorized access or exceeds the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
   • engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising and pyramid schemes, or the buying or selling of "virtual" items related to the Website.    • interferes with another user's use and enjoyment of the Website or any other individual's user and enjoyment of similar services;
   • refers to any website or URL that, in Our sole discretion, contains material that is inappropriate for the Website or any other website, contains content that would be prohibited or violates the letter or spirit of these Terms of Use.
   • harm minors in any way;
   • infringes any patent, trademark, copyright or other proprietary rights or third party's trade secrets or rights of publicity or privacy or shall not be fraudulent or involve the sale of counterfeit or stolen items;
   • violates any law for the time being in force;
   • deceives or misleads the addressee/ users about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
   • impersonate another person;
   • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
   • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation. (aa) shall not be false, inaccurate or misleading; (ab) shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force. (ac) shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;
2. You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve our right to bar any such activity.
3. You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, or to any of the services offered on or through the Website, by hacking, password "mining" or any other illegitimate means.

Breach

This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Jodhpur.

arghealthcare Infringement Verification (IIV) - Reporting Listing Violations

arghealthcare.in has put in place arghealthcare.in Infringement Verification process so that intellectual property owners could easily report listings that infringe their rights. It is in arghealthcare's interest to ensure that infringing products are removed from the site, as they erode Buyer and good Seller trust.

If you are a Verified Rights Owner and want to report a listing issue, see arghealthcare's IIV. Note: Only the intellectual property rights owner can report potentially infringing products or listings through IIV. If you are not the intellectual property rights owner, you can still help by getting in touch with the rights owner and encouraging them to contact us. If your listing was removed through IIV, and you believe that your listing was removed in error, please contact us.

arghealthcare does not and cannot verify that Sellers have the right or ability to sell or distribute their listed products. However, arghealthcare is committed to removing infringing or unlicensed products once an authorized representative of the rights owner properly reports them to arghealthcare.

IIV works to ensure that item listings do not infringe upon the copyright, trademark or other intellectual property rights of third parties. IIV participants have the ability to identify and request removal of allegedly infringing products and materials.

Any person or company who holds intellectual property rights (such as a copyright, trademark or patent) which may be infringed upon by products listed on Arg HelthCare is encouraged to become a IIV member.

Program membership entitles you (Verified Rights Owner) to the following benefits:
Rapid response by arghealthcare in ending listings reported by you (as the Verified Rights Owner) as allegedly infringing
Dedicated priority email queues for reporting alleged infringements
The ability to obtain identifying information about arghealthcare's users'

We respect the intellectual property of others. In case You feel that Your work has been copied in a way that constitutes copyright infringement You can write to us at customersupport@arghealthcare.info.

Risk of loss

All items purchased on the Website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon our delivery to the carrier.

Pricing/Typographical error

If Arg HelthCare comes across any difference in pricing resulting from typographic errors w.r.t pricing or product information, Arg HelthCare shall have the right to rectify the same or cancel the order(s) and refund monies, if any, collected from You within 10-15 business days of such corrective action taken. The mode of refund will be the same as at the time of placing the order. Cash on Delivery order refunds will be done by cheque.

Cancellation of order

We reserve the right to cancel any order at our sole discretion, under a situation where we are not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the our policy or for any other reason. However, we will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund will be made in reasonable time.

Limitation of Liability

IN NO EVENT SHALL Arg HelthCare BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THIS AGREEMENT, EVEN IF Arg HelthCare HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

Order can be cancelled before the shipment. Once order get cancelled amount will be refunded for 'prepaid orders'.

Cancellation Criteria

• Incorrect or Incomplete information regarding Customer's address (Street number, Landmark etc.) etc.
• In case of wrong product price or specification mentioned on arghealthcare.in
• Unavailability of products - in exceptional cases, if a product runs "out of stock" with the vendor, the Order will be cancelled.
• If area falls under "Non Serviceable zone" or "out of delivery area" by our Logistic Courier Partner even after placing the order in that case order can be cancelled.
• Suspected fraudulent information.

Refunds

• Once the order gets cancelled, Amount will be non refundable but you have 2 options either you can get a credit note or you can replace the product with another product of the same value.

What if I am not satisfied with product/services?

In case you are not satisfied with the product/services, you can get in touch with our customer care department and the team would ensure that the promised product/services are delivered to you.

Return Policy

• 1. Product is damaged/defective.
• 2. Differ from the description on the website.
• 3. Wrong item delivered/Wrong Colour/Wrong Size/Wrong Quantity.
• 4. Missing parts/accessories.

Return Eligibility

• In case of returning the product, customer needs to inform us within 7 days of receiving the order. In case, if you received a damaged product, it must be reported to us within 48 hours of delivery.
• If the product is delivered defective or damaged, in that case, customer needs to inform us through Register email ID and sent it to (customersupport@arghealthcare.info) or Call us at +91 9718560729 (Helpline Number) within 48 hours from the time of delivery.
• Products should be unused.
• All items must be returned in their original condition, with price tags intact, user manual, warranty cards, original accessories and in the original manufacturer’s box/packaging as delivered to you.
• Invoice should be available.
• Products marked as "non-returnable" on the product detail page cannot be returned such as Electronics, Cartridges, Safety, Tyres, Electricals & Car-care.

Returning a Product

There are 2 ways to Return the product. One is to return the product from our side where we send the courier partner and get the product picked up from customers. However, in some cases if we cannot provide return service then customer needs to send the product to us through India Post only. Once, the product is received by us, then we will reverse the courier charges.

Steps to follow to Return a Product

• Customer needs to inform us through call/email within 7 days of receiving the order.
• Product should be unused.
• Invoice should be available.
• We will raise a request for Reverse pickup and try to arrange it from our end. Once the pickup is arranged our courier partner will collect the product within 2-3 business days.
• Customer needs to pack the product with Brand packing & paste the invoice on it.
• Customer will handover the product to the courier boy.
• Once the pick up is done, product will be sent to us by the courier partner.
• After receiving the product, quality check will be done over the product by our team which takes 2 days time.
• If product is found damage/defective by our team, We will try to arrange a replacement; however, it depends on the availability of the product.

Once sent, customer needs to share the Courier slip along with the following bank details at customersupport@arghealthcare.info:

• 1. Account number
• 2. Account holder name (Same as registered with arghealthcare.in)
• 3. IFSC Code

• Incase, after receiving the product if we found any discrepancy by our Quality inspection team, we will re-ship product to the customer and in that case customer will have to bear the courier charges for re-shipment in order to receive the product. No courier charges for sending the product will be reimbursed.

Other Terms and Conditions

• Products marked as "non-returnable" on the product detail page cannot be returned such as Electronics, Cartridges, Safety, Tyres, Electricals & Car-care.
• Product Purchase under clearance sale will not be covered under Return policy.
• Products sold as combo can’t be returned individually.

Shipment confirmation & Order tracking

You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 48 hours.

Damages

arghealthcare.in is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim. Please save all packaging materials and damaged goods before filing a claim.

WARRANTY (T&C APPLY)

Services offered in Warranty period are free of cost. Product to be send to the company service center for claiming the warranty. Both side charges paid by the company within the warranty period. Physical Damage / Liquid Spill & damage caused by the Rat bite will not be covered under the warranty.

MASSAGE BED / MASSAGE CHAIR

Services will be offered on chargeable basis, depending upon the product.

We will give 1 year warranty only for those products on which the warranty tag is mentioned. On site warranty is applicable only for MASSAGE BED And Massage Chairs.

2. Clear identification or description of where the material that you claim is infringing is located on www.arghealthcare.in with adequate particulars. Product ID / website links of infringing products (in case of copyright infringement)
